There is new controversy brewing over what to do with a Santa Cruz man convicted of sodomizing and killing a 3-year-old girl.
Donald Schmidt, 38, has been behind bars since he was 16. In the late '90s, he was convicted as a juvenile and placed under the California Youth Authority.
He has fought for release ever since; and juries recently couldn't reach a decision over parole. According to the Santa Cruz Sentinel, the Santa Cruz District Attorney approved a deal that gives Schimdt parole for 3 years.
The DA's office reportedly didn't want to take a chance on a third jury.
Apparently, the state wants to put Schmidt in a home in Riverside County, but politicians and neighbors are not happy with the plan.
Additionally, Schmidt would not have to register as a sex offender because the sodomy conviction was later overturned.
